A prenuptial agreement can take the sting out of divorce cases but many clients attempt to overturn them when it comes to divorce battles, it seems the bigger the money, the bigger the war. It took a landmark judgment in 2000 to set a new starting point for the division of marital assets from the (usually) wife’s “reasonable needs” to a 50:50 split, based on the assumption that marriage is a partnership of equals, whoever made the fortune or created the home. But lawyers say they are now seeing a shift away from that approach to one that focuses on where those assets came from — and there is a “suspicion” that, as a result, settlements are becoming less generous.
